Terms & Conditions

Please read these terms carefully before placing an order with Swag Brokers. By ordering, you accept these terms in full.

Acceptance of Terms

By placing an order with swagbrokers.com — whether online, by phone, by email, or by fax — you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you are placing an order on behalf of a business, you represent that you have authority to bind that business to these Terms. If you do not agree to these Terms, please do not place an order.

Ordering

Please order directly from our website, by phone, by email, or by fax. When ordering by email or fax, please include your contact information so we can contact you directly should we have questions regarding your order.

Security notice: Please do not send credit card information via email. We will contact you by phone for payment information.

The current status of your order, its anticipated ship date and estimated transit time will be available in the My Account section of our website.

Product availability: Product inventory is not reserved or held until your order has been fully processed and payment arrangements have been made. Due to the nature of the promotional products industry, stock levels can change rapidly. In the event that an ordered item becomes unavailable after your order is placed, we will notify you promptly and offer a suitable alternative or a full refund.

Rush Orders

If you need an item sooner than the standard production time published on the item details page, please call. In most cases, we can accommodate reasonable requests for rush service, or recommend a product that can be produced in the time allowed. Some manufacturers charge a fee for rush service. You will be notified of any rush fees prior to production.

Event deadline? If you have an event, please make sure we are aware. While we do everything possible to meet your event date, some factors are outside of our control. Please order far enough in advance to accommodate any unexpected delays in production or shipping.

Note: Rush service does not guarantee delivery time. It only expedites the production process.

Artwork & Intellectual Property IP Rights

We can work with nearly any type of digital artwork file provided it meets one of these criteria:

  • Vector Files: AI, EPS or PDF file with all fonts converted to outlines and all placed images embedded.
  • Bitmap Images: High resolution JPG, TIF, GIF, or PNG saved at 300 dpi or better AND at imprint size or larger.
Please note: Bitmap images that start out as low resolution graphics cannot be saved at a higher resolution nor can they be converted to vector images (EPS).

If you order online, you can upload your art during the checkout process. You can also email your artwork to: graphics@swagbrokers.com. For larger files, please contact us at graphics@swagbrokers.com and we will provide secure file transfer instructions.

All logos and artwork are preserved in our archive for use on future orders and can be accessed and managed via your online account.

PMS Color Matching: We will always do our best to match your exact color requests; however, exact PMS color matching is not guaranteed on all substrates or decoration methods. Color reproduction varies significantly depending on the imprint process (e.g., screen print, pad print, sublimation, embroidery, laser engraving) and the substrate material (e.g., plastic, fabric, metal, glass). If an exact PMS match is critical to your order, please contact us before ordering so we can advise on the best product and method for your requirements.

By submitting artwork, logos, or other content to swagbrokers.com, you represent and warrant that: (a) you own all rights to such content or have obtained all necessary licenses and permissions; (b) the content does not infringe any third-party intellectual property rights, including copyrights, trademarks, or trade dress; and (c) you grant swagbrokers.com a non-exclusive license to use, reproduce, and produce such content solely for the purpose of fulfilling your order and archiving for future reorders.

Marketing use: You grant swagbrokers.com the right to photograph and display finished products bearing your artwork in our portfolio, website, social media, and marketing materials as examples of our work, unless you notify us in writing prior to order placement that you do not consent to this use.
Indemnification: You agree to indemnify, defend, and hold harmless swagbrokers.com and its officers, employees, and agents from and against any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from any third-party claim that your submitted artwork or content infringes any intellectual property rights.

Proofs

Every custom printed order requires customer proof approval prior to production. When you receive your proof, it is imperative that you double-check all of the details of your order for:

  • Imprint method
  • Spelling
  • Placement
  • Item color
  • Imprint color
  • Quantity
  • And all other specifications

If you have questions or see errors on the proof, please reject the proof and note the revisions. A new proof will be generated.

Your approval = your responsibility: Once approved, your order will be printed exactly as specified on the approved proof. Customer approval of the digital proof constitutes full acceptance of the design in its entirety — including any typos, design elements, placement, or layout choices — even if those errors were present in your originally submitted artwork or file. We will flag obvious concerns in red on the proof where possible, but we cannot guarantee we will catch every error. We cannot be held responsible for any oversight during the proof approval process.

Setup Charges

Custom imprinting your logo on an item requires printing plates, silk screens, film, programming, or embroidery tape charges, etc. These costs are independent of the actual costs of imprinting and are billed separately.

For most items these are one-time costs; however, for some items there are recurring charges should you reorder in the future. If you have questions about specific charges or fees, please contact us prior to ordering.

Cancellation

In most cases, custom imprinted orders may be cancelled any time prior to proof approval. Once the proof is approved, the order is moved immediately into production and hard costs are incurred.

  • Orders cancelled after production has started: May be subject to fees to cover costs incurred and/or items already produced.
  • Blank orders: May be cancelled any time prior to shipment.
  • Orders cancelled in production: The fee is a minimum of 25% and up to 100% of the total order based on the stage of completion.
  • Custom orders: May not be cancelled once product has shipped.
  • Blank goods: May or may not be returnable and are subject to manufacturer return policies and may be subject to restocking fees.

Returns & Refunds

When you receive your order, please check it thoroughly. Damage or discrepancies must be reported to customer service within 10 business days of receipt of goods. Claims made after this time will not be reviewed.

Non-returnable: Correctly printed customized items and special order items are not returnable.

In most cases, blank items may be returned in the original packaging. Shipping charges are not subject to refund. Blank merchandise returns may, at the factory’s discretion, be subject to a restocking fee in addition to the applicable return freight costs. Incomplete or partial returns will not be accepted.

Return Process:

  • All returns require a Return Materials Authorization Number (RMA).
  • Refunds are subject to review upon receipt of the return.
  • Return claims must be made within 10 business days of the receipt of purchased goods.
  • RMA claims may be subject to expiration, which may result in returns not being accepted.
  • Any additional fees assessed to the order at the time of purchase (such as less than minimum fees) are not subject to refund.
  • Unauthorized returns are not accepted.

Product Warranties Disclaimer

Our sole obligation for defective products is, at our discretion, replacement of the defective items or a refund of the purchase price, provided you notify us within 10 business days of receipt.

Customer Satisfaction

Absolute Customer Satisfaction is our #1 goal. We will do everything in our power to prevent mistakes on orders. We will not start production until you have signed off on your order acknowledgement and digital proofs.

In general, imprinted and customized items are not returnable, unless the item does not match the proof you were provided. Samples are generally available on most items and are recommended if you are not completely familiar with the item you are purchasing.

On larger orders, we recommend that you order an imprinted first article production proof. A few of our manufacturers charge a fee for this, but this is a good way to feel 100% comfortable with your purchase.

If your order is not exactly as you approved on your order acknowledgement and proof, we will replace the items and do whatever is necessary to make sure that you are 100% satisfied with your purchase and your experience.

Payments

Unless other arrangements have been made, all orders must be paid for before shipping. We accept most credit cards (Visa, MasterCard, American Express, Discover), corporate purchasing cards, or company check. Customers wishing to be put on Account status must fill out a credit application. Production will not start until your order acknowledgement and digital proofs have been approved and payment arrangements have been made.

Sales Tax

swagbrokers.com is based in Arizona. Arizona law requires us to collect applicable sales tax on products shipped to locations in Arizona. We do not charge tax on setup fees or shipping charges.

We are required to collect sales tax in states where we have nexus according to current tax laws and guidelines. For tax-exempt orders, please provide valid tax exemption documentation prior to ordering.

International Payments

As a general rule, swagbrokers.com cannot accept payments from outside the US. Orders placed from international sources will require other forms of payment such as bank wire or certified funds. Please contact us before placing international orders.

Minimum Order Size

In most cases, the minimum quantity you can order is the first quantity listed in the pricing grid. Some manufacturers will sell fewer, but may charge a fee to do so. If you have questions about minimum order size for a specific item, please call.

Overruns / Underruns

Industry standards allow 5%–10% variance on the quantity for customized items. You will only be billed for the quantity that is shipped to you. We make every effort to meet your order quantity exactly, but overruns are billable unless prior arrangements are made.

Shipping & Delivery

Shipping charges are estimated at the time of purchase based on the information at our immediate disposal and are generally accurate. On rare occasion, some unknown factors may affect the shipping cost such as oversized cartons, rural or residential deliveries, or expedited service to meet your required delivery date. If the shipping is substantially different than presented at checkout, we will contact you prior to processing your order.

International Shipments: Shipments outside of the United States may be subject to import fees. Customers are responsible for these costs.

Our preferred carriers are FedEx and UPS. We will determine the best shipping method based on your required delivery date, shipping location, and cost. Shipping is charged at the currently published rates by carrier. We do not charge handling fees over and above the published rates.

If you prefer to ship on your own UPS or FedEx account, please provide this information when you order. If shipping charges are not specified on your order acknowledgement, shipping will be billed post-shipment and this may show up as a separate charge on your credit card.

Risk of loss (F.O.B. Shipping Point): Title and risk of loss transfer to the buyer at the point the carrier accepts the shipment from swagbrokers.com or our manufacturer. Once goods have been tendered to the carrier, any loss, damage, or delay is the responsibility of the buyer or carrier. We will assist with carrier claims where possible, but we are not liable for carrier errors or losses that occur after the shipment has been accepted.
Shipping times and event dates: Transit times are estimates only and are not guaranteed delivery dates. If a product departs the factory on or before the confirmed ship date, swagbrokers.com has fulfilled its delivery obligation. We are not liable for missed event dates resulting from carrier delays that occur after on-time departure from the factory. swagbrokers.com is not responsible for shipping delays or late deliveries due to factors outside of our control, including but not limited to weather conditions, carrier delays, customs delays, natural disasters, carrier capacity issues, incorrect shipping addresses, and delivery area accessibility. Customers assume all responsibility for time-sensitive deliveries and are strongly encouraged to order well in advance of event dates. No refunds, credits, or replacements will be provided for orders that arrive late due to carrier delays.

Limitation of Liability Important

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

Force Majeure

swagbrokers.com shall not be liable for any delay or failure to perform its obligations under these Terms to the extent such delay or failure is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, strikes, labor disputes, supplier failures, fire, flood, government actions, or disruptions in transportation or supply chains. In such circumstances, we will notify you promptly and make reasonable efforts to complete your order as soon as practicable.

Governing Law Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or your order shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in such courts.

Any claim must be brought within one (1) year of the date the cause of action arose, or such claim shall be permanently barred.

General

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement: These Terms constitute the entire agreement between you and swagbrokers.com with respect to your orders and supersede any prior agreements or representations.

Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.

No Third-Party Beneficiaries: These Terms do not create any rights in third parties.

Compliance & Regulatory Notices Prop 65

California Proposition 65: If you are ordering products to be shipped to California, please be aware that many promotional products contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. Proposition 65 warnings are provided on applicable products based on data supplied by our manufacturers and suppliers. It is the buyer’s responsibility to ensure that products purchased comply with all applicable federal, state, and local laws and regulations, including Proposition 65 labeling and warning requirements, for the intended end use.

WARNING (California): Some products sold on this site may expose you to chemicals including lead, DEHP, or other substances known to the State of California to cause cancer and reproductive harm. For more information visit www.P65Warnings.ca.gov.

Sales Tax & Resale Certificates: Buyers are responsible for all applicable sales, use, and excise taxes. Business customers claiming a tax exemption or resale status must provide a valid resale certificate or tax-exemption documentation prior to order completion. Orders will be taxed at the applicable rate until a valid exemption certificate is received and approved.

Product Accuracy & Third-Party Data

Product Descriptions: Our catalog includes hundreds of thousands of products sourced from a large number of suppliers and industry data feeds. While we make every effort to ensure product descriptions, images, pricing, and specifications are accurate, we cannot guarantee that all information is current, complete, or error-free at all times. Product specifications are subject to change by manufacturers without notice.

Pricing Errors: In the event of an obvious pricing error — such as a price that is clearly incorrect due to a typographical error, data feed error, or system malfunction — swagbrokers.com reserves the right to cancel any order placed at the erroneous price, even after an order confirmation has been sent. We will notify you of any such cancellation and offer you the opportunity to place a new order at the correct price.

Third-Party Product Data: Product information on our website may be sourced from third-party industry data providers (such as ASI or SAGE). swagbrokers.com is not responsible for inaccuracies, omissions, or changes in data originating from these third-party sources. We are not liable for reliance on any third-party product data that proves to be inaccurate or outdated.

SMS Messaging Terms

By voluntarily providing your mobile phone number and explicitly opting in at checkout, you consent to receive transactional SMS messages from SwagBrokers related to order status updates, including order confirmations, production updates, and shipping notifications.

Message & Data Rates: Standard message and data rates may apply depending on your carrier.

Message Frequency: Message frequency varies based on your order activity. You may receive up to 4 SMS messages per order.

Opting Out: You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive one confirmation message and we will cease sending SMS messages to your number. To resubscribe, reply START.

Privacy: Your phone number will be handled in accordance with our Privacy Policy. We do not sell or share your mobile phone number with third parties for marketing purposes.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes your acceptance of such changes.
